A ban adopted by lawmakers in Montana, keeping a transgender representative out of his elected position in the state House for the rest of this legislative session, is being allowed to stand by a judge.
District Court Judge Mike Menahan rejected the demands from Rep. Zooey Zephyr, saying it was not within his powers to overrule lawmakers who voted to prevent Zephyr from taking to the House floor or participating in debates.
“Plaintiffs’ requested relief would require this court to interfere with legislative authority in a manner that exceeds this court’s authority,” Menahan said, according to a report at the Blaze.
The fight erupted when Zephyr, whose original name was Zachary Raasch, launched a verbal attack against Republican lawmakers as they were voting on one LGBT agenda point.
He said he hoped when they next prayed that they would look at their hands and “see blood.”
His privilege to be on the floor of House, and speak, was suspended by a House vote then, and later, after appearing to lead an “insurrection” by his supporters in the House chamber, he sued.
Zephyr had been triggered by debate over amendments to Senate Bill 99, the “Youth Health Protection Act” — already passed by the state House (65-33) and Senate (31-17) at the time.
The Blaze explained, “The bill prohibits doctors from performing genital mutilation and elective mastectomies on minors as well as from prescribing puberty blockers to children.”
Zephyr then attacked, “The only thing I will say is if you vote yes on this bill and yes on these amendments, I hope the next time there’s an invocation when you bow your heads in prayer, you see the blood on your hands.”
House Speaker Matt Regier said Zephyr would not be recognized again until he delivered an apology, and Zephyr refused.
The House censure vote found Zephyr had “violated the rules, collective rights, safety, dignity, integrity, or decorum of the House of Representatives, and if so, whether to impose disciplinary consequences for those actions.”
WND reported when the fight erupted that the lawmakers were considering restricting body-mutilating surgeries on children – a key component of the transgender ideology that the Joe Biden administration is promoting all across America.
Zephyr, a man dressing as a woman, originally was ordered silenced when he verbally assaulted GOP members. He was told he would be allowed to participate again following an apology to members, which he has refused to provide.
